Amy Ryburn is a partner at Buddle Findlay who specialises in commercial contracting and procurement, in particular in relation to technology, media and telecommunications (TMT).
Her TMT expertise includes drafting and negotiating agreements for cloud computing solutions, a full range of network and other telco services, and software development projects (using both agile and waterfall methodologies).
The use of agile methodologies in ICT projects is becoming increasingly common.
While there are many potential benefits to be gained from using agile methodologies in relation to certain types of projects, it can be a challenge to identify and manage legal risk.
Lawyers unfamiliar with agile methodologies can approach them with a fair amount of scepticism.
In this presentation, we consider how agile differs from waterfall from a legal perspective and what contracting challenges arise when using agile for ICT projects.
We address how contracts might be better drafted to address or mitigate identified issues and/or risksm and discuss some of the trends we are seeing in this space.
